3 Lists, First List Drops Totals

I have created 3 lists, one on top of another in a report studio page (see below)

When I execute the report, I receive a total row only for the second and third list, but never for the first list. If I move around this lists, the top list always drops the totals row. I have tried playing with the size and adding blocks and tables with no success

I found a way around this (which I dont like), by inserting a blank list at the top, which then fixes the issue for the first list, but not sure why it is working ?

Sounds very odd! Can you post up your report spec? If you build another report from scratch and add three lists (something very simple) do you see the same issue? How is the report structured - are the lists in the cells of a table? If so, is there anything odd going on in the properties of the first table cell?
